trioGuess terms of use

These terms are the rules for using trioGuess, the daily estimation game on the website trioguess.com and in the iPhone app. By playing, with or without an account, you agree to them; by creating an account, you expressly accept them. If you don't agree, don't use the game. What we do with your data is in the Privacy policy. This is a translation: if the two versions differ, the Portuguese version prevails.
1. The service
- trioGuess is run by João Lázaro Coré and Luiz Renato Morandi Borges, as individuals (“we”).
- The game is free. Every day there is a new challenge, which runs from midnight to the following midnight, Brasília time.
- We do our best to keep everything working well, but we don't guarantee that the game will always be online, free of errors or interruptions.
- We may change, pause or end the game, or parts of it (such as the leaderboard and leagues), at any time. If we are going to end the game, we will try to let you know beforehand, in the game itself.
2. Account and age
- You don't need an account to play. Without an account, your history is tied to this browser or device and is deleted after some time without playing (see the Privacy policy).
- Accounts are created with an email and password (and, when available, with Google or Apple). With an account, you show up on the leaderboard, can join leagues and keep the same history on any device.
- Age: trioGuess is not made for children under 13. To create an account, you must be 13 or older, or have permission from a parent or guardian. By creating the account, you confirm this and accept these terms.
- Use an email address that is yours and keep your password safe: currently, the game doesn't send emails, so it doesn't confirm the address or recover passwords by email. You are responsible for what is done with your account.
- You can delete your account whenever you want, under Settings › Privacy › “Delete my account” (or delete the data of a player without an account, under “Delete my data”).
3. Leaderboard and leagues
- Account holders join the world leaderboard automatically. Other players can see: the name you chose (use a nickname if you prefer), your country's flag (if any) and your results (average error in %, days played and streak).
- To show up on the 7-day leaderboard, you need to have played on at least 3 days in that period; on the overall leaderboard, on at least 10 days.
- There is no option to leave the world leaderboard. To leave it, delete your account. Signing out on a device doesn't remove you from the leaderboard.
- In leagues, members see the same information about each other and the league's name. You can leave a league whenever you want. If the person who created a league deletes their account, the league goes to another member.
- The leaderboard is just for fun: there are no prizes.
4. Conduct
In the name shown on the leaderboard and in league names, you may not use:
- offensive, discriminatory or hateful words;
- someone else's name, to pass yourself off as them;
- someone else's personal data (such as full name, phone number, address or social media profile);
- advertising (for products, services, websites or profiles).
In the game, you may not:
- cheat, for example by using bots or programs to play, or by creating several accounts or several players to find out the answers before guessing;
- try to see other players' data, exploit bugs or disrupt the game. If you find a bug, let us know by email.
If someone breaks these terms, we may rename, hide or delete the account, rename or delete the league, and remove results obtained by cheating from the leaderboard.
How to report: email luizrmb@icloud.com with the name shown on the leaderboard (and the league, if relevant) and the reason.
5. Challenge content
- The values in the challenges (sizes, weights and prices) come from public sources and are approximate. They are meant for the game and as trivia; they may contain errors and shouldn't be used to make decisions.
- Prices are a reference, for a place and a date. Prices change over time and from store to store. They are not an offer, a quote or a purchase recommendation: we don't sell anything.
- Once the day starts, the value used for scoring that day doesn't change, even if we find an error; we can only correct the texts and images. If you see an error, let us know.
- The brands and products mentioned belong to their owners and appear only to identify the item. trioGuess has no connection with, sponsorship from or endorsement by any of these brands.
- Images are illustrative: a photo may show a similar item, not necessarily the same model as in the question. The illustrations and photos belong to third parties and are used under their licenses; authors and licenses are listed in the Image credits. If you are the author of an image and something is wrong, write to us.
6. Intellectual property
- The trioGuess name, the game, its look, the code and the challenge texts belong to the people responsible for trioGuess. Third-party images follow the licenses listed in the Image credits.
- You can share the image of your daily summary and talk about the game as much as you like. You may not copy the game or the challenges, or use the trioGuess name as if it were yours, without our permission.
- The name you choose and the names of the leagues you create remain yours; you allow us to show them in the game while they are there.
- If you send us suggestions or challenge ideas, we may use them freely, with no obligation to pay.
7. Limitation of liability
trioGuess is offered free of charge and as it is. To the extent allowed by Brazilian law, including the Consumer Protection Code, we are not responsible for:
- interruptions, errors or the end of the game;
- loss of history, streak or results (for example, if you clear your browser's data, delete the app or go a long time without playing without an account);
- decisions made based on the values or prices shown in the game;
- what other players write in their names or league names (but if we receive a report, we act as described in section 4);
- external websites that appear in links.
Nothing in these terms takes away the rights the law gives you as a consumer.
8. Changes to these terms
If these terms change, we will update the date at the top. If the change is important, we will let you know in the game. If you keep playing after the change, it applies to you; if you don't agree, stop using the game and, if you have an account, delete it.
9. Law, venue and contact
These terms are governed by the laws of Brazil. Any dispute about them will be settled in the courts of your place of residence, as guaranteed by Brazil's Consumer Protection Code. Before anything else, write to us: we want to resolve things amicably.
